Location & Order of BusinessBob Collins is available to attend Mediations and Arbitrations throughout the State of New Mexico. Travel accommodations for events outside of Albuquerque and Santa Fe will be negotiated at the time of scheduling, but Bob does not charge an hourly rate for time spent traveling to out-of-town locations. However, in some circumstances room and board will be required and will be added to the Final Invoice at Cost. Unless the parties have a mutually agreeable location with private rooms available for each party, Mediations will be held at the State Bar Center in Albuquerque, NM and the fee for the rooms will be added to the Final Invoice at Cost. Bob will review all Confidential Statements prior to the mediation and will meet privately with all parties upon the start of Mediation. Bob does not require formal Opening Statements for Mediations. Upon reviewing the facts of the case and the parties’ respective stances and arguments, Bob will come to an independent assessment of the claim in an effort to resolve the dispute. After 40 years as a trial attorney for both plaintiffs and defendants, Bob has a keen sense what it will take to settle the dispute and enjoys the interplay between counsel and parties working toward a reasonable settlement. Bob officiated college football for 32 years as an umpire among huge, aggressive angry and sweaty young men and has developed an ability to calm the most contentious of parties. Above all, Bob enjoys Mediations and Arbitrations and feels the parties and counsel should also enjoy the quest to seek the best resolution. If a Mediation Conference proves unsuccessful but the parties wish to continue settlement discussions, Bob will be available to communicate such messages between the parties. There will be a minimum charge for such services. In this event, an invoice will be sent out for the Mediation Conference and a final invoice will be sent to the parties after Bob is no longer involved in the dispute.
Terms & ConditionsWe require 48 hours’ notice for all cancellations and rescheduling unless exceptional circumstances occur. The parties will be subject to any room fees charged to our office upon late cancellation. Less than 24 hours’ notice of cancellation is subject to a $200.00 charge. If Mediation is scheduled for Monday morning, Notice of cancellation or rescheduling is required by 5pm the Thursday before.
What to expectAfter contacting our office we will send an Information Request Form to be completed in its entirety in order to reserve a mediation conference. Please refer to the Calendar to view dates of availability. Our office prefers for the parties to agree on a date of mediation before contacting our office, but will be happy to work with counsel to find an acceptable date and time. Also please let us know if the parties require a half-day, full-day or multi-day reservation.
Once the Information Request Form is returned to our office, we will send out a confirmation letter within two (2) business days. In most cases Confidential Mediation Statements will be due two (2) business days before the event. Please limit all Statements to ten (10) pages, unless otherwise requested. Any additional documentation the parties may wish to provide should be sent to our office no less than 48 hours in advance, with a brief explanation of the need for supplementation.
